Explosives, weapons, ammunition and products and technology for military or police use, with respect to storage in facilities and warehouses in a manner that is safe for people, property and the environment.

Draft Regulation of the Minister for Development and Technology amending the Regulation on facilities and warehouses for the storage of explosives, weapons, ammunition and articles and technologies for military or police use

Draft Regulation:

1. clarifies the provisions of the Regulation of the Minister for Development, Labour and Technology of 5 August 2021 on storage facilities and warehouses for the storage of explosives, weapons, ammunition and products and technologies for military or police use (Journal of Laws, item 1674: hereinafter – the Regulation of 5 August 2021) in such a way that there is no doubt that the products listed in the title of the Regulation – regardless of whether or not they pose a potential threat to people, property and the environment during storage – must always be stored in accordance with the requirements of the Act of 13 June 2019 on the performance of economic activities in the field of production and trade of explosives, weapons, ammunition and products and technologies for military or police use (Journal of Laws of 2023, item 1743);
2. amends certain provisions of the Regulation of 5 August 2021 on fire protection so that they do not impose unjustified burdens for entrepreneurs and are adapted to actual fire hazards;
3. removes inaccuracies identified in the text of the Regulation of 5 August 2021 which may lead to misinterpretation of the requirements to be met by facilities and warehouses for the storage of explosives, weapons, ammunition and products and technologies for military or police use;
4. amends (extends) the transitional period provided for in the Regulation for adaptation to the requirements of the Regulation until 5 August 2021. Leaving the transitional period unchanged would mean that a significant part of it would expire before the notified amending Regulation enters into force at all.
