Draft Act on Combating Abuse in Electronic Communications

The Draft penalises abuses in electronic communication — generating artificial traffic, smishing, or actions of the nature of CLI spoofing in order to obtain a financial advantage or cause damage to another person.

Obligations and powers related to combating fraud in electronic communications shall be imposed on telecommunications companies.
Telecommunications companies shall be required, in particular, to:
1) implement proportionate organisational and technical measures to prevent abuse in electronic communications;
2) block short text messages that contain smishing content in accordance with the message template provided by the NASK CSIRT;
3) block voice calls that are intended to impersonate another person or institution.
Email providers for at least 500,000 users or public entities shall be required to use SPF/DKIM/DMARC authentication mechanisms for the provision of e-mail.
