Draft Decree stipulating conditions under which solid fuel from waste and fuel from waste biomass cease to be waste
The aim of the draft is to define the criteria by which the defined types of waste cease to be waste. The draft defines these criteria for solid fuel produced from waste and fuel produced from waste biomass.
The possibility to stipulate, at national level, criteria under which waste that has been subject to recycling or other recovery operations may cease to be waste and the essential requirements for such criteria is based on Article 6 of Directive 2008/98/EC of the European Parliament and of the Council of 19 November 2008 on waste and repealing certain Directives, as amended by Directive (EU) 2018/851.
The draft aims to simplify the use of fuels from waste in terms of the requirements of the Waste Act and its implementing legislation. This simplification should help to divert waste from landfill towards energy recovery.
The obligations stipulated in air protection legislation remain when incinerating these waste fuels.
