The Draft concerns:

1) fertilisers, i.e. products intended to supply plants with nutrients or increase soil fertility or increase the fertilityof fish ponds which include mineral fertilisers, natural fertilisers, organic fertilisers and org fertilisers

Draft Regulation of the Minister for Agriculture and Rural Development on the implementation of certain provisions of the Fertiliser and Fertilisation Act

Fertiliser and Fertilisation Act of 10 July 2007 (Journal of Laws of 2024, item 105) regulates, inter alia, theconditions and procedure for placing fertilisers and plant growing aids on the market and forms the basis forthe adoption of the draft Regulation.

On 13 July 2023, the Act on Facilitation of the Preparation and Realisation of Investments in AgriculturalBiogas Plants and their Operation (Journal of Laws, item 1597) was passed and introduced amendments tothe Act on Fertilisers and Fertilisation. The amendment consists in separating a new category of fertiliserproducts — digestate — from organic fertilisers and to make it easier to place them on the market. Under thenew rules, digestate products, unlike other organic fertilisers, shall not be subject to the authorisation of theMinister responsible for agriculture to place these products on the market. However, the provisions of the Actprovide for the Minister responsible for agriculture to determine, by regulation, the permitted types and valuesof contaminants that may be present in digestate with a view to ensuring the protection of human and animalhealth and the environment.
The Regulation lays down:
1) organisational units authorised to carry out tests on fertilisers and plant growing aids or to issue opinions onfertilisers and plant growing aids;
2) the detailed scope of the studies of fertilisers and plant growing aids as well as the elements to be includedin the opinion on fertilisers and plant growing aids;
3) the detailed scope of documentation on fertilisers and plant growing aids;
4) the requirements to be satisfied by the content of instructions for the use and storage of fertilisers, soilimprovers, and growth stimulants;
5. permissible types of contaminants present in fertilisers, plant growing aids, and digestate and their values;
6) minimum quality requirements to be satisfied by fertilisers.
