Act CVIII of 2001 on electronic commerce services and certain aspects of services associated withinformation society

(hereinafter: Electronic Commerce Act) complements its interpretative provisions with a precise definition ofgatekeeper and online accommodation referral service.
Pursuant to the Proposal, gatekeeper is defined as
companies that meet the objective criteria defined in Article 3 of Regulation (EU) 2022/1925. In this sense, abusiness qualifies as a gatekeeper
if it has a significant impact on the internal market, provides a core platform service that serves as an importantgateway for business users to reach end-users, and enjoys a consolidated and durable position in theiroperations, or is expected to acquire such a position in the near future.
According to the Proposal, an online accommodation referral service means a business that
provides online retail services to accommodation providers and consumers
with a view to ensuring that the range offered by accommodation providers is
coupled with accommodation demand, which, apart from providing information during the accommodationreferral activity,
ensures the sale of the accommodation services.
The draft sets out requirements for the provision of online accommodation referral services.
