The Swedish Civil Contingencies Agency’s draft regulations specifying the vital societal functions that arecovered by the Act (2023:560) on the screening of foreign direct investment

The society information services that are being added and are covered by this notification are marked with ablack line to the right of the text in the draft regulations. The following provisions are covered by thenotification:

Chapter 10 – Vital societal functions in the field of information and communication
Section 2 Operation, maintenance or provision of public electronic communication networks or publiclyaccessible electronic communication services, if the carrying out of the activity is subject to notificationpursuant to Chapter 2 of the Electronic Communications Act (2022:482), and the provision of number-independent interpersonal communications services.
Section 6 Provision of teleconferencing or videoconferencing systems, associated assistance services orsupport to the Swedish Civil Contingencies Agency or operations engaged in security-sensitive activities.
Section 7, paragraph 2 Activities in computer operating services related to hosting, i.e. hosting or managementof web pages and provision of the physical connection to the internet on behalf of others.
Section 7, paragraph 4 Activities in computer operating services related to the control, operation or support foralerting or digital signalling systems, for public or security-sensitive activities.
Section 8 Data programming services for the Swedish Civil Contingencies Agency or operations engaged insecurity-sensitive activities involving the development, installation, operation or support for customer-specificsystems, licensing provision or authorisation management.
Section 9 Activities related to electronic identification or trust services for electronic transactions as referred toin Article 3 of Regulation (EU) No 910/2014 of the European Parliament and of the Council.
Section 10, paragraph 1 Data consulting services for the Swedish Civil Contingencies Agency or operationsengaged in security-sensitive activities involving communication or transmission services.
Section 10, paragraph 3 Data consulting services for the Swedish Civil Contingencies Agency or operationsengaged in security-sensitive activities involving data security or system security.
Section 11 Operations specialising in IT or data services carrying out data recovery or data destruction, or ITauditing or security audits.
Section 12 Data processing services providing databases, or the management of data, for national registers, orautomated data scanning for public authorities or businesses.
Section 13 Development, operation, maintenance or provision of school administration platforms, learningplatforms or digital teaching tools pursuant to the Education Act (2010:800).
Section 14 Publication of digital or printed teaching material.
Section 15 Importing, reading, processing or storage of genetic or biometric data.
Section 17 Suppliers, and assistance services or support, of space systems or space services to the SwedishCivil Contingencies Agency or operations engaged in security-sensitive activities.
Chapter 14 – Vital societal functions in lettings/leasing, real estate services, travel services and otherassistance services
Section 2, paragraph 1 – Security system services involving on-site surveillance or remote monitoring of electronic alarm systems, burglary or fire alarms, including their installation or maintenance, for publicauthorities or businesses.
Section 4 Travel agency services for the Swedish Civil Contingencies Agency or operations engaged insecurity-sensitive activities.
Section 5 Invoicing services for the Swedish Civil Contingencies Agency or operations engaged in security-sensitive activities.
Chapter 16 – Vital societal functions in health and social care
Section 1, paragraph 2 Operations covered by the Health Care Act (2017:30) in the following fields: provisionof healthcare information or medical advice over the internet or on the telephone.
The main content of the draft regulations is to specify the vital societal functions in which foreign directinvestment is to be covered by the Swedish screening system for foreign direct investment.
The draft regulations do not include a mutual recognition clause. The regulations are not intended to regulatesociety information services, but merely to specify the investments in operations offering such services thatmust be notified for screening under the Foreign Direct Investment Screening Act.
These regulations concern Regulation (EU) 2019/452 of the European Parliament and of the Council of 19March 2019 establishing a framework for the screening of foreign direct investment into the Union. The draftregulations do not contain any Swedish national provisions.
