α-PVP, acetylfentanyl, 4-FA and phenazepam.

Decree amending Lists I and II annexed to the Opium Act in respect of the placement on List I of the substances α-PVP, acetylfentanyl and 4-FA and the placement on List II of the substance phenazepam.

The Decree provides for the placement of a number of new psychoactive substances on Lists I and II of the Opium Act. Pursuant to Articles 2 and 3 of the Opium Act, it is prohibited to move these substances into or out of the territory of the Netherlands, or to cultivate, prepare, work, process, sell, deliver, supply, transport, possess or produce them.

The placement of the substances α-PVP, acetylfentanyl and phenazepam on Lists I and II implements three resolutions of the UN Commission on Narcotic Drugs (CND) under the Single Convention on Narcotic Drugs and the Convention on Psychotropic Substances. Those resolutions (Nos 59/1, 59/4 and 59/7) added the substances acetylfentanyl, α-PVP and phenazepam to the treaties.

The Decree also implements Decision (EU) 2016/1070 (OJ L 178, 2016), which requires Member States to subject α-PVP to control measures in accordance with their national legislation.

Finally, the present Decree places the substance 4-FA on List I. The New Drugs Assessment and Monitoring Coordination Centre [Coördinatiepunt Assessment en Monitoring nieuwe drugs, CAM] has investigated this substance, and the risk assessment report shows that the acute toxicity of 4-FA is assessed as presenting a high risk to individual health and public health. The present Decree is notified with respect to the substance 4-FA.
