Through parliamentary motions, the Joint Committee on Agriculture and, subsequently, the Chamber of Deputies and the Senate approved the draft law on the preparation, description and labelling of milk products or products deriving from milk.

This draft text led to Law No. 21179, which was published in the Official Journal on 2 November 2019 and will enter into force nine months from this date, on 3 August 2020. This Law incorporates nine paragraphs into Article 105 of the Sanitary Code, which include definitions of milk (according to the species of animal) and the various technological treatments that it may undergo. They also incorporate new front-of-pack labelling requirements for milk and milk products, including the requirement to indicate the name of the country of milking along with the image of the corresponding flag(s).

The establishment under Law No. 21179 of new definitions for the description, labelling and processing of milk and milk products affects a number of articles of the Food Health Regulations on information on labels. This has resulted in the amendment of the current Article 107, to which provisions on labelling indicating the country of milking and its flag shall be added. This Article shall also define the characteristics of this labelling. Moreover, Article 109 shall be amended so that a self-adhesive label containing the above-mentioned information can be added to products. The definition of milk in Article 109 shall also be amended, with the aim of ensuring that it is consistent with the definition set forth in the Law.

In addition, the classification of milk established in Article 204 and provisions on the processing of milk and its labelling contained in Article 207 of the Food Health Regulations shall be amended, in order to ensure consistency and compliance with the Law. Furthermore, amendments shall be made to Article 208 on processing and authorization records, Article 209 on requirements for structures storing milk and Article 234 on the labelling requirements for cheese.
