Circular on environmental and energy considerations in government procurement

In government procurement, eco-labelling with the eco-label with the swan or the EU environmental label (or compliance with relevant labelling requirements, where not all labelling requirements can be required) shall be required for selected product groups, see point 6 where there is sufficient competition and where there is no significant price difference.

There is a draft provision (see attached draft circular) which reads as follows:

Section 6. When government contracting entities purchase or obtain tenders for contracts for the purchase of the product groups listed in Annex 1, it shall be required that the product bears the official Nordic eco-label (the swan mark) or the official European eco-label (the EU flower), or meets equivalent requirements documented by other appropriate documentation, without prejudice to paragraphs 2-3.

Paragraph 2. In cases where the contracting entity pursuant to section 46(1)(1) of the Public Procurement Act cannot require that all of the Nordic eco-label or EU flower label requirements have been met, the contracting entity must refer to the relevant label requirements in the tender documentation, see section 46(2) of the Tender Act.

Paragraph 3. The requirement referred to in paragraph 1 does not apply in the following cases:

1. Where the requirement does not allow the purchase of a product covering that need, in cases where there are specific requirements concerning the nature or function of the product.
2. When, in relation to the extent of the procurement, it will be disproportionate to impose such a requirement, see section 2 of the Tender Act.
3. [When a recycled product is purchased instead of a new product.] Paragraph 4. Eco-labelling Denmark (Miljømærkning Danmark) draws up and publishes guidelines for the assessment of the relevant labelling requirements that can be used in connection with the procurement of products covered by Annex 1.
