ROYAL DECREE LAYING DOWN PROVISIONS IMPLEMENTING EUROPEAN LAW ON OFFICIAL CONTROLS FOR ANIMAL WELFARE AND AMENDING CERTAIN ROYAL DECREES

1. This Decree sets an obligation on the Autonomous Communities and the Cities of Ceuta and Melilla to designate no more than two points of contact for the exchange of information on official controls for animal welfare.

2. It extends the obligation on pig and poultry farms to have on animal welfare plan as per Articles 6(1) of Royal Decree 306/2020 of 11 February 2020 setting out basic management rules for intensive pig farms, and Article 9(1) of Royal Decree 637/2021 of 27 July 2021 setting out basic management rules for poultry farms, to include all livestock farms.
3. It creates a National Reference Centre for Animal Welfare.
4. The Decree amends eight Royal Decrees to bring them into line with EU law, specifically:
a) it amends Royal Decree 1047/1994 of 20 May 1994 laying down minimum standards for the protection of calves, Royal Decree 348/2000 of 10 March 2000 transposing Directive 98/58/EC concerning the protection of animals kept for farming purposes, Royal Decree 3/2002 of 11 January 2002 laying down minimum standards for the protection of laying hens, Royal Decree 1135/2002 of 31 October 2002 laying down minimum standards for the protection of pigs and Royal Decree 692/2010 of 20 May 2010 laying down minimum standards for the
protection of chickens kept for meat production and amending Royal Decree 1047/1994 of 20 May 1994 laying down minimum standards for the protection of calves, to introduce the requirements for the controls in Regulation (EU) 2017/625 of the European Parliament and of the Council of 15 March 2017 on official controls and other official activities performed to ensure the application of food and feed law, rules on animal health and welfare, plant health and plant protection products, and the penalty regime of Law 32/2007 of 7 November 2007 on the care of animals in farming, transport, experimentation and slaughter, in the aforementioned Royal Decrees prior to their adoption;
b) it amends Royal Decree 361/2009 of 20 March 2009 governing the information on the food chain that must accompany animals intended for slaughter, to supplement the information on animals sent to the slaughterhouse;
c) it amends Royal Decree 37/2014 of 24 January 2014 governing aspects related to the protection of animals at the time of killing and Royal Decree 1086/2020 of 9 December 2020 regulating and increasing the flexibility of certain requirements for applying EU foodstuff production and distribution hygiene standards, and regulating activities not covered by their scope, to supplement the declaration of the farm owner in the case of slaughter outside a slaughterhouse, and to clarify the provisions on the certificate of competence.
