This amendment brings certain chemical fertilisers contained in repealed Regulation 2003/2003 under national law. In addition, it introduces the efficiency criteria applicable to by-products used to produce fertilisers and sets out the rules to admit animal by-products not intended for human consumption [SANDACH products] to the national compost system.

DRAFT ROYAL DECREE /2022 OF [DATE] AMENDING ROYAL DECREE 506/2013 OF 28 JUNE 2013 ON FERTILISER PRODUCTS

The draft consists of a sole article, one final provision and two annexes.

Sole Article. Amendment of Royal Decree 506/2013 of 28 June 2013 on fertiliser products. A new Article 6bis is now added, and Articles 8(3)(a) and 12(1)(h) and Annexes I and II are now amended. These changes pertain to the inclusion of ammonium nitrate fertilisers of high nitrogen content, micronutrient mixtures, label indications and the declaration of secondary nutrients and micronutrients in subgroup 1.4 created by Order APA/104/2022 of 11 February 2022.
Moreover, a new additional provision (sixth) and two annexes (IX and X) are now added. These amendments respond to the need to adapt fertiliser regulations to the provisions of Law 7/2022 of 8 April 2022 and to enable normal operation of the Register of Fertiliser Products. Both the aforementioned Law and Regulation (EU) 2019/1009 provide for the use of waste and by-products in fertiliser production and set some criteria that should also apply to the production of national fertiliser products.
The Sole final provision states that the Order will enter into force on the day following its publication in the Official State Gazette [BOE].
