Regulation of the State Secretary for Infrastructure and Water Management of ........, no IENW/BSK-, amending the Environmental Regulation in relation to the updating of the interest rate and the minimisation obligation for substances of very high concern
This amending regulation introduces two amendments to the Environmental Regulation, which may contain technical requirements.
This amending regulation implements two changes to the Environmental Regulation. First, the interest rate to use when assessing the existence of excessive costs related to the environmental benefits referred to in Article 8.28 (2) of the Decree on the quality of the living environment is updated. This amendment is part of a broader package updating the rules on industrial emissions into the air. The other amendments to the package are included in the Decree amending the Decree on the quality of the living environment related to the updating of
the rules on industrial emissions. The second amendment guarantees that the methodology to calculate cost-effectiveness also applies to the assessment of the efficiency of techniques used in the preparation of prevention and reduction programs to comply with the minimisation obligation for substances of very high concern set out in Article 5.24 of the Environmental Activities Decree in order to comply with the minimisation obligation.
The Environmental Regulation already contains a system of mutual recognition provisions (Article 1.3). The limited amendments intended by this Decree shall not implement any change to these.
