NMHH Decree amending Decree No 7/2015 of 13 November 2015 of the National Media and

Infocommunications Authority (NMHH) on national frequency allocation and on the rules of use for frequency bands (NFFF) (hereinafter: Draft NFFF amendment)

The draft NFFF amendment contains amendments based on the WRC-19 findings (World Radiocommunication Conference 2019, World Radiocommunication Conference) of the International Radio Regulations, which are specified in Annex 1 concerning international allocation and in Annexes 2 and 3 in connection with national allocation and the national rules of use for frequency bands.

As regards clarifications, changes to some previously implemented ITU (International Telecommunication Union) and CEPT/ECC documents have been incorporated, including the updating of the references to the documents. The draft also covers the transposition of changes within CEPT/ECC in the field of satellite regulation, allowing the use of fixed land stations with non-geostationary satellite systems in several bands.
Changes to the list of harmonised standards whose references have been published in the Official Journal of the European Union and that serve as a basis to the presumption of conformity with spectrum management and certain other essential requirements referred to in Directive 2014/53/EU of the European Parliament and of the Council of 16 April 2014 on the harmonisation of the laws of the Member States relating to the making available
on the market of radio equipment and repealing Directive 1999/5/EC (RED), are hereby incorporated.
In addition to the above, some clarifications and editorial simplifications, which have become necessary in the application of the law, are implemented. (Clarifications of the text affect several frequency bands, but they do not entail changes to the applicable regulatory concept for these bands.)
The draft also updates Annex 4 on international coordination documents, taking into account the coordination agreement as amended in 2020.
The regulation of the draft also supports the development of the Hungarian space industry by opening or declaring new bands for space operations and space research.
Concerning the use of interfering devices for non-civil purposes, the draft provides a definition and general rules for their use also in line with Recommendation ECC/REC/(04)01.
Furthermore, the draft contains general provisions for the allocation of the 32 GHz frequency band through a competitive procedure.
The draft NFFF amendment also involves the transposition of
– the designation provision under Article 1(1) of Commission Implementing Decision (EU) 2020/590 of 24 April 2020 amending Decision (EU) 2019/784 as regards an update of relevant technical conditions applicable to the 24.25-27.5 GHz frequency band, and
– Commission Implementing Decision (EU) 2021/1067 of 17 June 2021 on the harmonised use of radio spectrum in the 5 945-6 425 MHz frequency band for the implementation of wireless access systems, including radio local area networks (WAS/RLANs).
