Order amending the Order on the reporting of tobacco substitutes

On 11 November 2021, the Danish Parliament presented the draft Act amending the Health Act, the Electronic cigarettes, etc. Act and the Tobacco Products Act, etc.

The legislative proposal amends the fee models for products covered by the Electronic cigarettes, etc. Act and the Tobacco Products Act, etc.
The bill contains a number of provisions enabling the Minister for Industry, Business and Financial Affairs to lay down detailed rules. The Amending Order lays down requirements that notified tobacco surrogates are subject to a fee obligation.
The amending Order contains rules that the amount of the fees is set on the Danish Safety Technology Authority’s website, as well as information on when and how fees are due and a provision on a de minimis threshold for collection.
