The proposed Regulations have been prepared to ensure to an adequate level the safety of equipment and installations against risks during use due to pressure of fluids (liquids or gases) and the transport of flammable fluids (piping systems). The above mentioned Regulations promote the protection of all the persons at work, as well as and as far as this is reasonably possible, of all the other persons who may be affected by the activities of employees, against of all risks arising by and from the operation of fluid systems.

The Occupational Safety and Health (Fluid Systems) Regulations of 202x

In order to continue to be ensured an adequate level of safety of equipment against of all the risks during use and operation arising due to fluid pressure (liquids or gases) and the transport of flammable fluids (piping line systems), the relevant “Occupational Safety and Health (Fluid Systems) Regulations were prepared”. The Regulations are part of the larger package of Legislation on Occupational Safety and Health.

The scope of the Regulations extends from the safety in operation of steam boilers, steam receivers and air chambers (existing legislation) to other equipment and installations with significant (hazardous) size and pressure, which are not covered by other harmonisation or national legislation and which involve significant safety hazards. These risks arise mainly from the side pressure, but may also be related to the properties of the fluid content such as networks containing flammable liquids (regardless of pressure level).
The Regulations refer to economic operators such as manufacturers, owners, users and managers.
Manufacturers of pressure systems must assess the risks and prepare technical documentation, affix safety markings and provide instructions. The owners must maintain and control their equipment.Users must use only secure equipment within their operating limits, for the authorisation of the inspectors, supervises their work, investigates complaints, conducts extraordinary inspections and generally checks the good and proper application of the Regulations.
The Minister of Labour, Welfare and Social Insurance shall be given the tools and the power, through the establishment of standards and codes of practice, to regulate the minimum level of safety allowed for pressure equipment and fluid networks.
while the operators of network systems with dangerous fluids shall ensure the good condition of the network and shall provide information to the competent authority, the Department of Labour Inspection which is and remains as such, in relation to the risks arising from their activities.
An important person in the provisions of the Regulations is the Authorised Auditor of Systems under Pressure.
This is a private auditor coming from the private sector with knowledge, experience and ability to diagnose and assess not only the current condition of the equipment, but also the ability to determine the limits of safe operation and the frequency of checking the equipment, always within the limits of the discretion also defined in the same legal framework.
The Department of Labour Inspection, which, with the responsibilities and powers conferred on its Director, shall ensure the supervision and enforcement of legislation shall be the depositary of supervision and enforcement of the legislation.
in order to authorise auditors, to supervise their work, to investigate any complaints, to conduct extraordinary inspections and to generally check the properly good and proper implementation of the Regulations.
