Electronic identification means

Decree laying down the procedures for certifying electronic identification means and the specifications enabling the presumption of reliability of those means to be established

The draft decree is issued pursuant to Article 86(I) of Law No 2016-1321 of 7 October 2016 for a Digital Republic, which supplements Title I of Book III of the Postal and Electronic Communications Code with a new Article L. 102. The latter provides that proof of identity for the purposes of accessing an online communication service may be furnished by an electronic identification means and that the latter is presumed to be reliable until proven otherwise if it meets the requirements of the specifications drawn up by the national information systems

security authority and has been certified by that authority. This Decree lays down
1. the content of these specifications and establishes the level of reliability required of the electronic identification means in order to benefit from the legal presumption of reliability as referred to in Article L. 102(2) of the Postal and Electronic Communications Code. These associated specifications retain the high level of guarantee as defined by Implementing Regulation (EU) 2015/1502 as the main requirement of the presumption of reliability.
