The draft Rules for the use of the radio frequency spectrum after registration has been developed regarding the provisions of art. 30, item 8 and Art. 66a, par. 3 of the Electronic Communications Act (ECA) (amend. and supplemented State Gazette issue 20 dated 9 March 2021). Pursuant to Art. 66a, par. 1 of the Electronic Communications Act, the use of the radio frequency spectrum – free, after registration or after issuance of authorisation shall be determined by rules.

These rules stipulate the conditions for using the radio frequency spectrum and the technical parameters for operation of electronic communication networks that use radio frequency spectrum after registration.
The project describes the order for carrying out electronic communications, the contents of the register, the order of entry in a register, a procedure for resolving disputes between persons using radio frequency spectrum after registration is provided.

Rules for use of radio frequency spectrum after registration

The rules shall contain texts relevant to:

• permissible radio frequency bands and frequency allocations, relating to electronic communication networks that use radio frequency spectrum after registration;
• content of the register – technical parameters, identification of registered persons and period of use of the radio frequency spectrum;
• procedure for carrying out electronic communications after registration – filing an application, checking the technical feasibility of the requested connectivity with the available networks in the register, rectification of inaccuracies in the application, deadlines for satisfying the application;
• procedure for registration, termination of registration and refusal of registration;
• procedure for resolving disputes between persons using spectrum after registration.
The document also includes information on the mode of use of the frequency resource, specifying the applicable technical standards, which ensure compliance of radio equipment with the essential requirements laid down in Directive 2014/53/EU.
