The Regulation is issued on the basis of Article 64 of the Food Act.

Draft Regulation on the specific requirements for distance selling of food

The draft lays down the specific requirements for distance selling of food and for carrying out official controls of this activity. The draft Regulation aims to ensure the traceability and safety of food marketed by means of distance selling, as well as to ensure the provision of information to consumers.

In accordance with the draft, distance selling of food is to be carried out only by persons registered or approved pursuant to Article 26, Article 31 or Article 61 of the Food Act.

Information about food supplied by means of distance selling are to be provided in accordance with the requirements of Article 14 of Regulation (EU) No 1169/2011 of the European Parliament and of the Council of 25 October 2011 on the provision of food information to consumers, amending Regulations (EC) No 1924/2006 and (EC) No 1925/2006 of the European Parliament and of the Council, and repealing Commission Directive 87/250/EEC, Council Directive 90/496/EEC, Commission Directive 1999/10/EC, Directive 2000/13/EC of the European Parliament and of the Council, Commission Directives 2002/67/EC and 2008/5/EC and Commission Regulation (EC) No 608/2004 (OJ, L 304/18 of 22.11.2011), of the Food Act and of the regulations for its implementation.

The draft provides for the use of vehicles, meeting the hygiene requirements of Chapter IV, Annex II to Regulation (EC) No 852/2004, and/or Heading III of Chapter Two of the Food Act, for the purposes of transporting food offered by means of distance selling.

Motorcycles, mopeds, individual electric vehicles and bicycles, as well as postal and courier services, under conditions specified in the draft Regulation, may be used in the distance selling of food.

The draft provides for the use of vehicles, meeting the hygiene requirements of Chapter IV, Annex II to Regulation (EC) No 852/2004, and/or Heading III of Chapter Two of the Food Act, for the purposes of transporting food offered by means of distance selling.
