Construction Act Amendment 2020

In the case of an existing combustion plant, the replacement of a boiler with a boiler that allows the use of liquid fossil or solid fossil fuels and fossil liquefied gas is not to be permitted. This does not apply to the replacement of the burner and control devices.

The replacement ban does not apply
1. in the event of an unreasonably long interruption of the building conditioning or hot water supply exclusively for the duration of the unreasonable condition for the installation of an emergency boiler or
2. to boilers powered by liquid fossil fuels and used exclusively as an operationally necessary failure reserve.
