Systems for gambling and gaming equipment supervision

Draft Decree of the Council of Ministers on the adoption of a Regulation on the general mandatory technical requirements for the systems for gambling and gaming equipment supervision

Currently the matter governed by the draft Regulation is regulated by General mandatory technical requirements for the systems for gambling and gaming equipment supervision, adopted by the State Commission on Gambling to the Ministry of Finance, published in the State Gazette (SG) No 58 of 2013, issued on the basis of the Gambling Act, in its version prior to the amendments published in the State Gazette (SG) No 69 of 2020. A provision has been made in the amendments that these public relations be governed by a regulation of the Council of Ministers, adopted at the proposal of the Minister for Finance pursuant to Article 17(3)(4) of the Gambling Act.

The provision of Article 17(3)(4) of the Gambling Act provides for the issue of a regulation on both the general mandatory technical requirements for systems for gambling and gaming equipment supervision and the general technical and functional requirements for gaming software and communication equipment for online betting and games by other electronic means of communication. The significant differences in the requirements for these processes in the organisation of online gambling compared to the organisation of terrestrial gambling, mainly
related to differences in the functions of the central computer systems and the requirements for gaming software, have led to the separation of the matter set out in that provision into two regulations - a regulation laying down the general mandatory technical requirements for systems for gambling and gaming equipment supervision, proposed in this draft, and a regulation on the general technical and functional requirements for gaming software and communication equipment for online betting and games by other electronic means of communication.
The draft Regulation proposes determining the minimum requirements for systems for gambling and gaming equipment supervision, as well as the minimum mandatory content of the rules that gambling organisers must submit for approval to the Executive Director of the National Revenue Agency pursuant to Article 17(1)(4) of the Gambling Act with regard to the technical requirements for systems for gambling and gaming equipment supervision and in particular to the technical requirements for the central computer system, related to information security; access control; the general technical requirements for slot machines; systems for supervision and gaming equipment for tournament games; the requirements for jackpot formation systems; gaming equipment for organising casino gambling; general mandatory technical requirements for gaming facilities for conducting the number lottery games Totto, Lotto, Bingo and Keno; a random number generator.

The changes in the gambling activity regulation in the Republic of Bulgaria, adopted by the Act amending the Gambling Act, published in the State Gazette (SG) No 69 of 2020, have been taken into account in this draft. Thus, throughout the Regulation, the acts and the actions of the gambling regulator are imposed on the Executive Director of the National Revenue Agency as powers. References to the rules of the Gambling Act have been introduced in accordance with any amendments to the provisions thereof. Any inconsistencies and incompleteness in terminology have been eliminated.

The proposed draft Regulation on the general mandatory technical requirements for the systems for gambling and gaming equipment supervision brings the secondary legislation in line with the current revision of the Gambling Act, thus providing for the proper determination of the general mandatory technical requirements for systems for gambling and gaming equipment supervision.
Pursuant to the provisions of Article 26(3) of the Legal Acts Act, the draft act provides for public consultations.
The draft Decree of the Council of Ministers, the draft Regulation, the report thereto, the partial preliminary impact assessment and the opinion of the Directorate - “Modernisation of the Administration”, which is part of the administration of the Council of Ministers, have been published on the website of the Ministry of Finance and on the Public Consultation Portal for a period of 30 days.
