Decree of the Council of Ministers on the adoption of a Regulation on the provision of food information to consumers

The draft Regulation on the provision of food information to consumers lays down national measures for the provision of food information to consumers in accordance with Article 44 of Regulation (EU) No 1169/2011 of the European Parliament and of the Council of 25 October 2011 on the provision of food information to consumers, amending Regulations (EC) No 1924/2006 and (EC) No 1925/2006 of the European Parliament and of the Council, and repealing Commission Directive 87/250/EEC, Council Directive 90/496/EEC, Commission

The Regulation is issued on the basis of Article 19 of the Food Act.
The draft Regulation on the provision of food information to consumers lays down:
1. the requirements for the indications or marks identifying the lot to which a foodstuff belongs in accordance with Directive 2011/91/EU of the European Parliament and of the Council of 13 December 2011 on indications or marks identifying the lot to which a foodstuff belongs;
2. national measures on the provision of food information to consumers by virtue of Article 44 of Regulation (EU) No 1169/2011.

The Regulation defines provisions related to the provision of food information to consumers in accordance with the requirements of Regulation (EU) No 1169/2011, the requirements laid down in special provisions of EU regulations for certain foods, the Food Act and the regulations for its implementation, as well as the provisions that aim to introduce certain requirements for the indications or marks identifying the lot to which a foodstuff belongs. The Regulation introduces national measures for the provision of information where foods are offered for sale to the final consumer or to mass caterers without pre-packaging. Until now, only food ingredients that cause allergies or intolerances had to be indicated in accordance with the current European legislation (Regulation (EU) No 1169/2011 on the provision of food information to consumers). However, that Regulation entitles the Member State concerned, at its own discretion, to introduce national measures and other requirements as regards the provision of information to consumers on those foods. In this regard, the draft Regulation introduces requirements for the sale of food without pre-packaging whereby their name, the date of minimum durability or the ‘use by’ date, and the business operator that offers the food on the market must also be indicated. A requirement is introduced for the provision of additional particulars, in accordance with Annex III to Regulation (EU) No 1169/2011, for certain types or categories of food.
