Electronic cigarettes and refill containers

Order on a registration scheme for the manufacture, storage and placing on the market of electronic cigarettes and refill containers with or without nicotine

On 8 October 2020 Folketinget (the Danish Parliament) submitted a bill amending the Act on the ban on tobacco advertising etc., Act on tobacco products etc., Act on electronic cigarettes etc. and various other acts (Implementation of the national action plan against smoking by children and young people). The bill implements the political agreement for a national action plan against smoking by children and young people. The bill contains a number of provisions enabling the Minister for Industry, Business and Financial Affairs to lay down detailed rules.

The Order lays down requirements for the registration of information from any entity manufacturing, storing and placing on the market electronic cigarettes and refill containers with or without nicotine.

The Order contains rules on which information and changes in information must be registered by any entity manufacturing, storing or placing on the market electronic cigarettes and refill containers with or without nicotine and on the places where they are manufactured, stored or placed on the market.

Under these rules, it will be a requirement for the Danish Safety Technology Authority to confirm that correct registration has been submitted before the product may be manufactured, stored and placed on the market.

On the basis of the registered information, the Danish Safety Technology Authority will publish a list that shows where electronic cigarettes and refill containers with or without nicotine are placed on the market. The intention is for consumers to be able to use this list to inform themselves of which retail outlets may lawfully place these products on the market.
