This draft is intended to immediately transpose into Belgian law certain provisions of a European directive introducing a ban on the use of oxo-degradable plastics (that can be broken down chemically or that can break down into small plastic particles) as well as on certain other single-use plastic products.

In addition to the prohibitive provisions introduced in said directive, this draft also introduces a ban on the use of single-use plastic bags.

Draft Act amending the Act of 21 December 1998 on product standards to promote sustainable production and consumption patterns and to protect the environment, public health and employees, in order to introduce a ban on the use of oxo-degradable plastic products and certain other single-use plastic products

The draft is intended to amend the Act of 21 December 1998 on product standards to promote sustainable production and consumption patterns and to protect the environment,

public health and employees.
It introduces a ban on placing certain products onto the market. To this end, it adds several definitions to the Act of 21 December 1998 (Article 2 of the draft) and inserts a new Chapter IVbis ‘Special provisions on single-use plastic products’ (Article 3).
More specifically, the ban on placement onto the market covers products based on oxo-degradable plastic (Article 4), certain single-use plastic products (Article 5) and certain single-use carrier bags designed for packing or carrying goods purchased at indoor or outdoor points-of-sale.
