Railway vehicles

The Swedish Transport Agency’s regulations on the authorisation of railway vehicles according to the Railway Technologies Act (xx)

The proposal replaces the Swedish Transport Agency's regulations (TSFS 2010:116) on the authorisation of subsystems for railways that need to be reviewed in view of what is known as the fourth railway package (EU regulation). The regulations contain provisions on the authorisation and temporary authorisation of railway vehicles covered by the EU regulation and on exemptions from the application of the technical specifications for interoperability (TSI). The rules should be read in conjunction with the Commission Implementing Regulation (EU) 2018/545 of 4 April 2018 establishing practical arrangements for the railway vehicle authorisation and railway vehicle type authorisation process pursuant to Directive (EU) 2016/797 of the European Parliament and of the Council.

Rules on the authorisation of vehicles that are not subject to EU regulation will be contained in separate regulations (the Swedish Transport Agency's regulations on the authorisation of railway vehicles for national railway systems, which are notified at the same time as these).

The proposal is part of the implementation of Directive (EU) 2016/797 of the European Parliament and of the Council of 11 May 2016 on the interoperability of the rail system within the European Union. The directive provides the conditions for notifying vehicle authorisations that apply to 'area of use', which may involve the vehicle having an approved area for use in several Member States. Therefore, there is no reason to have a mutual recognition clause.
