Citrus pulp: by-product resulting from the processing of citrus fruit to produce juices, essential oils, fibre or other foodstuffs or otherwise for use in foodstuffs in accordance with the characteristics set out in Annex 3 to the notified draft.

Draft Regulation establishing rules permitting the production, marketing and use of pulp as a by-product of the processing of citrus fruit and its use in agriculture and livestock rearing, in accordance with Article 41-quater of Decree-Law No 69 of 21 June 2013, converted into law with amendments by Article 1(1) of Law No 98 of 9 August 2013.

The draft Decree, comprising seven articles and three annexes, establishes rules permitting the production, marketing and use of pulp as a by-product of the processing of citrus fruit for use in agriculture and livestock rearing, and more specifically:

- Article 1 lays down the purpose of the Decree;

- Article 2 contains the definitions used for the application of the Decree;

- Article 3 sets out detailed conditions for pulp to be classified as

a by-product for use in agriculture and livestock rearing, in addition to mandating that said requirements be

complied with in all management stages, from the time of production to

the time of use of the pulp, including all marketing phases;

- Article 4 specifies the documentary evidence operators must supply and, more specifically,

the declaration of conformity and the technical information sheet, as well as their contents;

- Article 5 provides clarification in relation to the ‘certainty of use’ requirement;

- Article 6 lists transport and storage conditions, setting out the relevant fundamental principles, with a view to ensuring that environmental and health protection are guaranteed in said stages;

- Article 7 lays down the final provisions, specifying that the annexes form an integral part

of the Decree.

Annex 1 specifies the information to be included when filling out the documentary evidence (declaration of conformity and technical information sheet).

Annex 2 lists some of the more common procedures, which are considered to be

standard industrial practice, under the conditions set out in the articles.

Annex 3 provides a description of the technical characteristics of citrus pulp

in its various forms (pulp as is, dried pulp, depectinised pulp or pulp with added calcium carbonate). This annex therefore lays down the rules for the use of the different pulp types in agriculture and livestock rearing.
