Energy drinks

Draft Government Decision establishing certain measures to prevent and restrict the effects of the consumption of energy drinks by the public

The following are defined in the context of the draft legislation: energy drinks, substances stimulating the central nervous system (caffeine, carnitine, guarana) and the vulnerable groups at risk of consuming energy drinks.

Energy drinks are drinks containing various combinations of carbohydrates, vitamins, minerals and one or more substances stimulating the central nervous system: caffeine, taurine, carnitine, guarana, glucuronolactone and other compounds.

Main provisions: (1) it is prohibited to sell energy drinks to persons under 18 years; (2) it is prohibited to sell energy drinks from dispensing machines; (3) it is prohibited to sell energy drinks in healthcare facilities or on the premises of (or within 50 metres of any point of entry to) educational establishments, with the exception of higher education establishments. This distance is to be measured along the length of the public road.
