Agricultural production, fur animals, breeding, breeding ban, compensation

Act No 255/2017 amending Act No 246/1992 on the protection of animals against cruelty, as amended.

The Act prohibits the breeding and killing of fur animals, specifically from 1 February 2019. After the amendment, § 5(7) of the Animal Protection Act reads as follows: ‘It shall be prohibited to breed and kill animals for the sole or predominant purpose of obtaining fur.’ § 29c(1) of the Animal Protection Act reads as follows: ‘If, as of the date of entry into force of § 5(7) of this Act, a breeder breeds animals, with the knowledge of the regional veterinary administration, for the sole or predominant purpose of obtaining fur (hereinafter ‘breeding of animals for fur’), this activity shall be ceased in accordance with the existing legislation by 31 January 2019.’.

In addition, the amendment to the Animal Protection Act concerns the competence of the Ministry of Agriculture to grant one-off financial contributions from the state budget to mitigate the impacts on breeders who breed animals for fur in the context of their commercial activity and who cease this activity during the transitional period referred to in § 29c(1) (hereinafter the ‘compensatory contribution’).

According to § 29c(6) of the amendment to the Animal Protection Act, the details of the method and scope of granting the compensatory contribution are to be laid down by the Ministry of Agriculture in an implementing decree.

The amendment was notified under 2016/664/CZ, however, the notification process was terminated early due to withdrawal of the notification by the Member State. Neither the Commission nor the Member States gave a response to the notification.
