National Media and Infocommunications Authority Decree amending National Media and Infocommunications Authority Decree No 7/2015 of 13 November 2015 on national frequency allocation and the rules of use for frequency bands

Based on national legal obligations, we have conducted the due inspection of National Media and Infocommunications Authority Decree No 7/2015 of 13 November 2015 on national frequency allocation and the rules of use for frequency bands (hereinafter: ‘Decree No 7/2015’).

This draft transposes the following two EU acts into national law:

a) Commission Implementing Decision (EU) 2018/637 of 20 April 2018 amending Decision 2009/766/EC on the harmonisation of the 900 MHz and 1 800 MHz frequency bands for terrestrial systems capable of providing pan-European electronic communications services in the Community as regards relevant technical conditions for the Internet of Things, and

b) Commission Implementing Decision (EU) 2018/661 of 26 April 2018 amending Implementing Decision (EU) 2015/750 on the harmonisation of the 1 452-1 492 MHz frequency band for terrestrial systems capable of providing electronic communications services in the Union as regards its extension in the harmonised 1 427-1 452 MHz and 1 492-1 517 MHz frequency bands.

Transposing the Commission Implementing Decision (EU) 2018/637 makes it possible to extend the use of the 900 MHz and 1 800 MHz bands designated for the provision of mobile services to additional technologies (IoT, the Internet of Things).

By transposing the Commission Implementing Decision (EU) 2018/661, the draft expands the 1 452-1 492 MHz band designated for the provision of broadband mobile services to include the 1 427-1 452 MHz band; thus, those who already have the right to use the frequencies necessary for operating the terrestrial fixed and mobile communications system enabling wireless electronic communications services can create additional downlinks in the 1 427-1 492 MHz band in order to increase capacity.

As another objective of the inspection, the outcome of the World Radiocommunications Conference in 2015 (hereinafter: ‘WRC-15’) has also been fully transposed; Annex 2 to Decree No 7/2015 on national allocation and rules of band use is finalised through this amendment.

The latest edition of the 2014 NATO Joint Civil/Military Frequency Agreement (hereinafter: ‘NFJA’) and its public version published in 2017 have been fully transposed in Annex 2 to Decree No 7/2015 on national allocation and rules of band use.

At the initiative of the Hungarian Radio Amateur Society, the review of frequency bands and performance restrictions applicable to the service of amateurs was continued. The results of the amendment covering the 30-1 300 MHz frequency range are included in this draft.

As part of the revision of the 160 MHz band regulation, to satisfy the user needs, the time limit on the usage of 160 MHz military radars is modified from 2023 to 2028 by the draft, whereby the use of the BKV system is further ensured, the shared frequency use of volunteer firemen has been specified and the implementation of digital PMR systems of civil self-defence organisations has been made possible.

As part of the inspection of the 400 MHz band regulation, the draft makes the full civil band part of the 410-430 MHz band available for PMR systems for lack of demands for PAMR systems, while allowing greater channel division for newer systems using higher modulation order in the 440-450 MHz band than at present.

The reframing process of the 15 GHz band that has been going on for many years, affecting both civil and non-civil systems, is expected to be completed on 31 December 2018. In this context, other regulations concerning the transitional period to be ended on 31 December 2018 have also been reviewed, while making it possible to simplify the regulation of the 8 GHz band.

The terrestrial electronic communications networks in the 26 GHz band are specified under planned status in Annex 2 to Decree No 7/2015 in order to prepare for the introduction of the fifth generation (5G) of mobile systems in the 26 GHz band.

The draft also reflects the results achieved in the inspection of RH and URH military applications.
