Draft act on construction products and their use in buildings and amending certain acts

This act is a comprehensive legal regulation concerning the introduction and supply of construction products on the market and the use of construction products in buildings. It lays down the conditions for introducing and supplying specified construction products on the market in the Czech Republic which do not fall within the scope of Regulation (EU) No 305/2011 of the European Parliament and of the Council (non-harmonised area). The aim is to adapt national legislation to the European system and eliminate fundamental systemic differences and discrepancies, such as replacing the declaration of conformity with a national declaration of properties, etc. At the same time, this act transposes the adaptation provisions in connection with the implementation of Regulation (EU) No 305/2011 of the European Parliament and of the Council which have been integrated into the general domestic Act on technical requirements for products since 2013.

The act furthermore lays down requirements for the design and use in buildings in the Czech Republic of specified construction products as well as of construction products with a CE mark to which Regulation (EU) No 305/2011 of the European Parliament and of the Council applies. It contains statutory authorisations to issue implementing decrees on the properties of construction products. The aim is to specify requirements for construction products in terms of their intended use in buildings in the Czech Republic, in particular with respect to climatic, geological, geographical and other domestic conditions and in terms of fulfilling the basic requirements for buildings in the form of a list of properties of construction products which are essential for their design and use in buildings.

At the same time, this act includes an amendment to the Act on technical requirements for products and an amendment to the Construction Act.
