This draft measure is intended to set rules for flares, namely a requirement to supply a launcher with the sale of flares and to use of this launcher when using flares.

Order of the State Secretary for Infrastructure and Water Management of ........, No IENM/BSK-2018/…, amending the Consumer and Theatrical Pyrotechnic Articles (Designation) Order, in connection with the introduction of the launcher requirement for flares

Articles A and B, resulting in amendment of Articles 1 and 2(7) and (8) of the Consumer and Theatrical Pyrotechnic Articles (Designation) Order may contain technical regulations. These provisions restrict the sale and use of pyrotechnic articles of category F2, namely flares.

The following requirements are imposed:

- Vendors are required to supply a launcher with the sale of flares;

- Users are required to use a launcher when setting off flares.

A launcher is defined as follows: an object that is suitable for multiple use and that was manufactured for stable vertical firing of different types of flares into the air from both paved and unpaved surfaces.

A mutual recognition clause is not necessary. This sets a requirement for vendors of flares within the Netherlands to supply a launcher. Consumers are free to purchase flares from vendors in other countries, without supply of a launcher.
