Draft Act on accessibility to digital public services

The draft act implements Directive (EU) 2016/2102 of the European Parliament and of the Council of 26 October 2016 on the accessibility of the websites and mobile applications of public sector bodies (the Web Accessibility Directive). Under the draft act, digital services provided by a public body via a technological solution under the control of the public body will be accessible in accordance with the accessibility requirements of regulations issued pursuant to the act. The Web Accessibility Directive is a minimum harmonisation directive and the draft act contains certain provisions that go beyond the minimum requirements. In addition to the stakeholders covered by the Directive, the draft act will also cover private operators whose professional activities are publicly funded and involve kindergartens, schools, healthcare and social care. The same applies to private educational institutions that are accredited to issue degrees and for which state subsidies are the main source of funding for higher education at undergraduate, graduate or postgraduate level. In addition, digital services provided via a technological solution under third party control shall, as far as possible, meet the same requirements as digital services provided via a technological solution under the control of the stakeholder concerned.
