The planned ordinance regulates the storage of aerosol dispensers within the meaning of the 2017 Aerosol Dispenser Ordinance, Federal Law Gazette II No 200/2017, for storage quantities with a net weight of up to 5 000 kg per fire compartment in commercial production facilities.

Aerosol dispensers within the meaning of this ordinance are non-reusable containers made from metal, glass or plastic which contain compressed, liquefied or pressure-released gas and may or may not contain liquid, paste or powder. These dispensers have a valve to release their contents in the form of solid or liquid particles suspended in gas as a foam, paste, powder, or in a liquid state.

Ordinance of the Federal Minister for Digital and Economic Affairs and the Federal Minister for Labour, Social Affairs, Health and Consumer Affairs on the storage of aerosol dispensers in commercial production facilities (Aerosol Dispenser Storage Ordinance [Aerosolpackungslagerungsverordnung - APLV])

The planned ordinance repeals the Order on the storage of pressurised gas containers 2002, Federal Law Gazette II No 489/2002, and simplifies the existing legislation. For example, the ordinance sets out requirements which, subject to compliance, would render authorisation obligations for commercial production facilities unnecessary. It also simplifies the presentation of aerosol dispensers in sales outlets and does away with excessive and impractical provisions.
