Draft Law Amending and Supplementing a Number of Articles of the Law on Prevention and Control of Tobacco Harms; (4 page(s), in Vietnamese)

The Draft Law comprises 2 Articles:

Article 1. Amendments and supplements to a number of articles of the Law on Prevention and Control of Tobacco Harms:

1. Amends Clause 1 and adds Clauses 1a, 1b, 1c, 1d, 1đ and 1e after Clause 1 of Article 2, thereby amending and supplementing the definitions of tobacco, conventional tobacco products, electronic cigarettes, e-cigarette liquids, heated tobacco products, electronic devices, specialized tobacco products and other new tobacco products.

2. Amends Clause 4 of Article 3 to supplement the State's policies on prevention and control of tobacco harms.

3. Adds Clause 5 to Article 5 to supplement provisions on State management responsibilities for prevention and control of tobacco harms.

4. Amends and supplements a number of provisions of Article 9 on prohibited acts.

5. Amends Clause 1 of Article 12 on indoor places where smoking is prohibited but designated smoking areas are permitted.

6. Amends Clause 1 of Article 19 on tobacco business management.

7. Amends Clause 4 of Article 21 on control of investment in tobacco production.

8. Amends Article 25 on the sale of conventional tobacco products.

9. Deletes the phrase "except for establishments specified in Point b, Clause 2 of this Article" in Point b, Clause 1 of Article 11, and deletes the phrase "colleges, universities and academies" in Point b, Clause 2 of Article 11.

10. Repeals Point b, Clause 3 of Article 10 and Clause 4 of Article 17.

Article 2. Effect:

1. This Law shall enter into force on 1 January 2027.

2. Amends, supplements and repeals a number of provisions in laws related to prevention and control of tobacco harms.
