Draft Law of Ukraine "On the Reduction of the Impact of Plastic Products on the Environment"; (17 page(s), in Ukrainian)

The draft Law lays down the legal and organizational framework for reducing the negative impact of certain types of plastic products on the environment and human health, and for promoting the transition to a circular economy, in particular through measures aimed at preventing and reducing the generation of waste resulting from the use of such products.

The draft Law establishes requirements governing the production, import, placing on the market and making available on the market of certain single-use plastic products, oxo-degradable plastic products and fishing gear containing plastic.

The draft Law provides, inter alia, for:

·        the establishment of measures to reduce the consumption of certain single-use plastic products;

·        restrictions on the production and placing on the market of certain single-use plastic products and oxo-degradable plastic products;

·        ensuring that single-use plastic products with plastic caps and lids may be placed on the market only if the caps and lids remain attached to the container during the product's intended use;

·        the establishment of a target for recycled plastic content in plastic beverage bottles;

·        labelling requirements for certain single-use plastic products;

·        the establishment of extended producer responsibility schemes for certain single-use plastic products, as well as for fishing gear containing plastic placed on the market;

·        the separate collection of plastic beverage bottles;

·        the establishment of measures to inform consumers and encourage responsible consumer behaviour with a view to reducing waste generated from single-use plastic products covered by the draft Law;

·        the establishment of reporting and record-keeping systems;

·        liability for non-compliance with the requirements established by the draft Law.

The draft Law has been developed on the basis of Directive (EU) 2019/904 of the European Parliament and of the Council of 5 June 2019 on the reduction of the impact of certain plastic products on the environment, taking into account the need for transitional periods to enable economic operators to adapt to and implement the measures laid down therein.
