Australia and New Zealand share a joint food regulation system for food labelling and composition. New Zealand can diverge from Australia in specific circumstances.

In August 2024, New Zealand opted out of the amended Australia New Zealand Food Standards Code – Standard 2.9.1 – Infant formula products.

New Zealand can issue domestic food standards where it has opted out of joint food standards. New Zealand is consulting on a draft New Zealand Infant Formula Products Standard (the Standard), which provides regulatory requirements for the composition, labelling and representation of infant formula products in New Zealand.

The Standard aligns with Australian requirements for infant formula products as closely as possible, by incorporating by reference sections of Standard 2.9.1. The Standard also includes New Zealand-specific provisions for labelling that enable:

1.    statements of specific protein fractions; and

2.    ingredient claims that are not misleading.

Following consultation and subsequent amendments, the draft Standard will progress to the New Zealand Cabinet for consideration.
