Commission Regulation (EU) No 10/2011 of 14 January 2011 on plastic materials and articles intended to come into contact with food was adopted in Israel under Amendment No. 10 to the Public Health Protection (Food) Law, 5776–2015 (hereinafter – the Law / the Food Law), and appears in Item 16 of Annex II A to the Law. The exclusions from the adoption of Regulation 10/2011 appear in Column A of Item 16 of Annex II A, in addition to the exclusions set out in Section 3A(a1) through (a5) of the Law. This Regulation was applied in Israel solely with respect to the following:

(a) A proper importer importing food through the European track;

(b) A manufacturer holding a proper manufacturing approval or a manufacturer holding a commitment submission approval, in whom the provisions of Section 321A of this Law are fulfilled;

(c)  A distributor who purchased or received food from those referred to in paragraphs (a) or (b).

On 16 December 2025, the Public Health Protection Order(Food) (Application of Amendments to European Union Provisions), (Regulation 10/2011 – Plastic Materials and Articles Intended to Come into Contact with Food), 5785–2025, was published bearing the signature of the Minister of Health, applying amendments that had been made in the European Union to Regulation 10/2011, all of which are included under Item 1 in Column A of the Schedule to that Order. The updated consolidated text that was adopted and published on the Food Service website following the publication of the Order was the text in force in European legislation as of 16 March 2025. The annotated translation of the consolidated text did not include the amendment to the Regulation detailed below, as the part concerning Regulation 2024/3190 relating to the use of Bisphenol A (BPA) and other bisphenols and bisphenol derivatives had not yet been adopted in Israel.

It is now proposed to apply in Israel the amendments made in the European Union to Regulation 10/2011, published up to the date of publication of this Order, by incorporating them into the text of Regulation 10/2011 as currently adopted. The principal amendments concern the regulation of bisphenols in a separate regulation – Regulation 2024/3190 – which it is proposed to adopt in Israel by a separate order pursuant to the Minister's authority under Section 3A(f)(1) of the Law to amend Annex II A to the Law, as well as the update of the positive list in Table 1 of Annex I to Regulation 10/2011. It is further clarified that the exclusions appearing in Column A of Item 16 of Annex II A shall continue to apply with respect to the amendments proposed to be applied in Israel. The changes included in this proposed amendment combine the following EU Regulations amending various Annexes of Regulation (EC) No. 10/2011, after Item No. 1:

·        Item 2 - Commission Regulation (EU) 2024/3190 of 19 December 2024 on the use of bisphenol A (BPA) and other bisphenols and bisphenol derivatives with harmonized classification for specific hazardous properties in certain materials and articles intended to come into contact with food, amending Regulation (EU) No 10/2011 and repealing Regulation (EU) 2018/213

1.    Addition of subsection (6) to Section 6

2.    Amendment of Table 1 in Annex I: deletion of the entries for substance No. 151 (2,2-bis(4-hydroxyphenyl)propane) and substance No. 154 (4,4'-dihydroxydiphenyl sulphon).

·        Item 3 - Commission Regulation (EU) 2026/245 of 2 February 2026 amending Annex I to Regulation (EU) No 10/2011 as regards the authorization or the conditions of use of several substances

1.    Amendment of Table 1 in Annex I - (a) Replacement of the entry for substance No. 768; (b) Addition of entries for substances Nos. 1084, 1089, 1092, 1093, 1094, 1096.

2.    Amendment of point 3 in Table 3 of Annex I by adding footnote (31) for substance No. 1094.
