The provisions of Sections 3A(f)(2), (g) and (g1) of the Public Health Protection (Food) Law, 5776 – 2015 (hereinafter – the Law) allow the Minister of Health to determine by order, extensions to the adopted provisions in Appendix II A, after receiving the approval of the Israeli Parliament (Knesset) Health Committee and consultation with the Professional Advisory Committee, but without receiving the recommendation of the Exceptions Committee, provided that these are extensions that permit or enable the use of a process, food product, substance or quantities beyond what is permitted under an annex to an adopted provision.
Following the aforementioned, after the Professional Advisory Committee has delivered its recommendations to the Minister and in accordance with these recommendations, the Minister requests to determine by order the extensions to the annexes to the adopted European Union Regulation No. 396/2005, which concerns maximum levels of pesticide residues (hereinafter – the Extension Order). The Extension Order proposes to determine extended maximum residue levels of certain pesticides in relation to certain crops, beyond the levels set out in Appendices II to V to Regulation 396/2005, all as detailed in the appendices to the draft proposed order.
In order for the provisions of the extension order to apply and prevail over the provisions adopted in Regulation 396/2005, they must be set out in Column C, Item (4) of Appendix II A to the Law, in accordance with the provisions of Section 3A(a4) of the Law. Therefore, it is proposed in this draft order to amend Appendix II A to the Law as stated above, subject to receiving the approval of the Knesset Health Committee under Section 3A(g) of the Law, so that the changes that the Minister requested to be set out in the extension order are incorporated therein. This is done by amending Item 4 under Column C of Appendix II A to the Law and referring to the provisions of the extension order, so that the provisions of the extension order regarding the maximum residue levels of pesticides set out there in relation to certain crops, will apply in the place set out in the appendices to the regulation 396/2005, as amended. According to Amendment No. 10 to the Public Health Protection (Food) Law, 2015, under Column A - Exclusions and Applicability of Local Food Legislation, Section 4 - Regulation 396/2005, it is stated: "1 - The provisions of the regulation shall not apply to fresh fruits, fresh vegetables, raw meat, raw milk, honey, fresh eggs in their shells;".
