The notified draft Royal Decree updates the legal framework for the production and management of waste industrial oils, in accordance with Law No. 7/2022 of 8 April and the other applicable regulations, in order to prevent the human health and environmental risks of these oils and to reduce their generation. It also updates the extended responsibility for producers of oils for industrial use placed on the domestic market.

To this end, the draft Royal Decree establishes:

·        The obligation that waste industrial oils be collected separately, specifically to prevent their mixing with water or other waste.

·        Priorities in the management of waste industrial oils, whereby priority is given to regeneration followed by conversion to fuel and, only lastly, energy recovery.

·        The extended producer responsibility framework for industrial oils, in accordance with Law No. 7/2022 of 8 April, whereby producers of oils for industrial use shall be required to register under the relevant section of the Register of Product Producers, to supply information annually relating to the placing on the market, and to cover, at least, the costs of the separate collection of waste industrial oils, the costs of their transportation, analysis and storage and, when destined for regeneration, the processing costs. They shall also cover the costs of informing users and holders of waste industrial oils about prevention measures, and the costs of collecting and reporting data.
