Draft Order supplementing Implementing Regulation (EU) 2019/947 on the rules and procedures for operating unmanned aircraft (Drone Order); (38 page(s), in Danish), (2 page(s), in English)
The draft Executive Order contains supplementary and further provisions on the formal and operational rules governing the operation of unmanned aircraft (drones) in Danish airspace, in addition to those laid down in Commission Implementing Regulation (EU) 2019/947 of 24 May 2019 on the rules and procedures for the operation of unmanned aircraft. The draft Executive Order also lays down technical requirements for the use of drones in Danish airspace, supplementing those laid down in Commission Delegated Regulation (EU) 2019/945 of 12 March 2019 on unmanned aircraft systems and on third-country operators of unmanned aircraft systems. The draft Order on drones introduces a technical requirement that all drones weighing above 250 g must be operated with direct remote identification (also known as 'remote ID') throughout all of Denmark, and that drones weighing less than 250 g must be operated with direct remote identification in aviation-safety-critical and aviation-security-critical drone zones. The requirement will apply to civil aviation and to aircraft carrying out activities or services under the control and responsibility of a Member State, undertaken in the public interest by or on behalf of a body vested with the powers of a public authority, as well as to the personnel and organisations involved in those activities and services. Military aviation is excluded. Remote identification is already an applicable EU product requirement for certain drones, but not for all drones. Denmark is therefore introducing requirements that are more stringent than those currently applicable at EU level.
The notified provisions pursue public-interest objectives relating to public security, the protection of human life and health, and aviation safety and security, encompassing both aviation safety and aviation security. The purpose of the draft proposal is to ensure that drones and drone operators can be identified in situations and areas where a lack of electronic conspicuity may pose a risk to manned aviation, aerodrome operations, critical societal functions or other safety or security interests. The draft proposal therefore introduces requirements relating to remote identification and electronic conspicuity for specified drones and operations in cases where the applicable EU rules do not in themselves ensure electronic conspicuity to the extent considered necessary in view of Denmark's particular aviation-safety and aviation-security conditions.
