Draft law on Tourism in the Basque Country

This regulatory proposal concerns only companies operating online platforms or portals and other digital supply channels that advertise or provide short-term accommodation services for tourism purposes. Its purpose is to ensure a more transparent, secure and traceable digital environment. To that end, it seeks to improve the supervision of digitally intermediated tourism activity, ensuring compliance with applicable sector-specific regulations.

This Chapter sets out the obligations of companies operating online platforms, portals and other digital channels that advertise, intermediate or facilitate short-term tourist accommodation located in the Basque Country. Its application is not dependent on the operator’s place of establishment and is limited to those activities that have an impact on the planning of the tourism sector in the Basque Country.
The purpose of these obligations is to ensure the traceability of the tourism offering and to strengthen the effectiveness of administrative oversight, within the framework of the autonomous communities’ powers in the field of tourism. They apply in accordance with Regulation (EU) 2022/2065 and Regulation (EU) 2024/1028 on the exchange of data relating to short-term accommodation rentals.
Platforms must adapt their interfaces to make the provision of the tourist registration number a mandatory requirement for publishing an advert, by including a mandatory field to be completed, the accuracy of which is the sole responsibility of the advertiser. Furthermore, they must remove any advertisements that do not bear a registration number upon receipt of a formal request from the department responsible for Tourism.
