The Decree on the cadavers of an equidae and animals within the hobby breeding

The aim of the Draft is to clarify the content of records in case of burial of animal cadavers, thereby ensuring the uniform application of the generally formulated requirements of the Regulation for keeping records of the incineration or burial of animal by-products in application practice.

Commission Regulation (EU) No 142/2011 chooses a general formulation that allows for the application of provisions when incineration or burial of any type of animal by-products (hereafter ‘ABP’) for which this harmless disposal method is authorised by EU rules. For ABP, which under certain conditions are animal products, feedstuffs, parts of animal bodies or e.g. skins or feathers — see Article 19(1)(a) to (f) of Regulation (EC) No 1069/2009 — it will be necessary to record their quantities, i.e. the number of kg or the number of pieces.
Therefore, in order to apply the general provisions of the Annex to the Regulation uniformly in practice in the Czech Republic, its implementation is proposed, which consists of adapting the content to the fact that the cadavers of specific animals are involved.
As regards the category of ABP, equidae cadavers are Category 2 material in accordance with Article 9 of Regulation (EC) No 1069/2009 of the European Parliament and of the Council. According to Article 8 of the Regulation, the cadavers of animals are Category 1 material. Again, the logic behind the Regulation is that it does not apply only to buried animal cadavers, but to all types of ABP of different categories that can be disposed of by authorised methods, hence in an incineration plant, for example, different categories can be incinerated. However, such a situation cannot arise in the case of cadavers of animals covered by the Draft Decree, as the category of these ABP is laid down directly by the Regulation. The requirement to record the data on the category of the ABP would be superfluous in this case, because from the logic of the matter, the burial of equidae is Category 2, and in the case of the burial of animals, it is Category 1.
