The draft amendment to the Order sets out the Bulgarian national requirements for the use of construction products in construction works in the Republic of Bulgaria in relation to their intended use, as follows:

- construction products for which harmonised standards have been published, in accordance with Annex 1 to the Order;
- construction products for which no harmonised standards have been published, in accordance with Annexes 2 and 3 to the Order.

Draft amendment and supplement to the Order with Bulgarian national requirements for the use of construction products in construction works of the Republic of Bulgaria

The drafted national annexes to the harmonised standards of Annex 1 are in compliance with the requirement of Article 8(6) of Regulation (EU) No 305/2011 of the European Parliament and of the Council of 9 March 2011 laying down harmonised conditions for the marketing of construction products and repealing Council Directive 89/106/EEC. They include the requirements for determining the essential characteristics necessary to achieve the threshold levels, where appropriate, depending on the purpose of the product. The national annexes do not contravene or contain requirements for characteristics (levels and classes) and methods which are outside the scope of the harmonised standards.

The requirements for construction products for which no harmonised standards have been published are laid down in accordance with European and International standards (EN and ISO) in Annexes 2 and 3 to the draft amendment to the Order.
Article 8(1) of Regulation No RD-02-20-1 on the use of construction products at construction works in the Republic of Bulgaria establishes the recognition of national standards with methods and requirements equivalent to Bulgarian standards, as well as the documents issued by accredited agencies (Article 14(2) of the Regulation) in accordance with the requirements of Article 5 of Regulation (EC) No 2019/515 of the European Parliament and of the Council of 19 March 2019 on the mutual recognition of goods lawfully marketed in another Member State and repealing
Regulation (EC) No 764/2008.
The requirements set out in the draft amendment to the Order apply to the use of construction products and are not connected to the marketing of construction products. Market surveillance does not require compliance with the national requirements set out in the Order.
