The technical inspection of sprayers.

Draft Royal Decree amending the Royal Decree of 13 March 2011 on the mandatory inspection of sprayers and amending the Royal Decree of 10 November 2005 on the payments referred to in Article 5 of the Law of 9 December 2004 on the financing of the Federal Agency for the Safety of the Food Chain.

The main adjustments included in the draft Decree (see Annex) are summarised below:

• The inspection requirements (Annex 1 of the Royal Decree of 13 March 2011) and the inspection protocol (Annex 5 of the Royal Decree of 13 March 2011) for nebulisers and grain handling facilities were added.
• Nebulisers used only for the application of non-agricultural biocidal products as well as fertiliser spreaders used only for the application of fertilisers shall be exempted from the technical inspection of sprayers.
• The owner of a sprayer may apply to the Agency for an exemption from inspection on the following grounds:
- The sprayer is used outside agriculture and not for irrigation, fertigation or applying plant protection products or biocidal products;
- The sprayer has been modified in such a way that it is no longer suitable for applying plant protection products.
The application will be discussed at the Technical Committee for sprayers (consultation between FAFSC-CRA-ILVO). If an exemption is granted, the owner of the sprayer shall receive an exemption certificate.
This certificate is valid for two inspection cycles, including the current cycle.
• The payments are not modified in this proposal.
