Regulation of the Minister of Health amending the Regulation on mushrooms that have been authorized for marketing or production of mushroom preserves and food products containing mushrooms, and certification of mycologist and mushrooms expert

The draft Regulation extends the list of mushrooms authorised for marketing or for production of mushroom preserves and foodstuffs containing mushrooms which shall enable Polish operators to produce and market new species of mushrooms and mushroom preserves, and foodstuffs containing these. After the entry of the Regulation into force, the mushroom species listed in points 1 to 5, 7, 8, 10, 13, and 14, 19, 23, 25, 39, 47, 49, and 50, 52, 56 to 59, 62, and 63, and 72 to 76 of Annex 1 to the Regulation may be used for production.

Furthermore, for the mushroom species listed in points 5, 19, 22, 24, 50, and 51, 58, and 59, 68, 71, and 75 of Annex 1 to the Regulation, it is specified that they may originate exclusively from or outside the territory of the Republic of Poland. In the case of mushrooms listed in points 5, 50, and 59 of Annex 1 to the Regulation, obtained from wild populations outside the territory of the Republic of Poland, it is required to obtain the authorisation referred to in the provisions issued pursuant to Article 50 of the Nature Conservation Act of 16 April 2004 (Journal of Laws of 2021, item 1098 and 1718). In the case of mushroom species listed in points 35 and 74, it is specified that they may originate from outside the territory of the Republic of Poland, and in the
case of the mushroom species mentioned in points 60 and 61, it is specified that they may originate exclusively from gardens, horticultural crops, forest tree nurseries, and green areas or from outside the territory of the Republic of Poland. In addition, the name has been updated for the mushroom species listed in points 48, 53, 68, and 70.
As a consequence of the amendments to Annex 1 to the Regulation, Annex No 2 the List and types of mushroom preserves authorised for marketing shall be amended as regards the indication of the species of mushrooms which may be authorised for the production of certain mushroom preserves and foodstuffs containing mushrooms.
