Dairy sector

Draft Royal Decree laying down basic rules for the registration of dairy operators, movements of milk and control in the area of primary production and up to the first unloading.

The draft consists of twenty-seven articles, two additional provisions, four transitional provisions, one repeal, three final provisions and seven annexes, with the following content:

Article 1: Aim and scope.
Article 2: Definitions.
Article 3: General register of agents and containers in the dairy sector.
Article 4. Obligations of the agents.
Article 5. Identification code of agents, establishments and containers.
Article 6. Entry in the general register and identification of containers.
Article 7. Record of milk deliveries, delivery receipts and movements register.
Article 8. Notification of movements to the Letra Q database.
Article 9. Letra Q database.
Article 10. Letra Q database access system.
Article 11. Party responsible for health and hygiene checks on the holding.
Article 12. Mandatory health and hygiene checks on the holding.
Article 13. Taking samples on the holding.
Article 14. Analysis of samples taken on the holding.
Article 15. Mandatory checks at the first-unloading dairy centre.
Article 16. Taking samples in the first-unloading dairy centre.
Article 17. Analysis of the samples collected in the first-unloading dairy centre.
Article 18. Action following on-site testing for bacterial growth inhibitor residues.
Article 19. Analysis laboratory.
Article 20. Information from the analysis laboratories.
Article 21. Information from first buyers.
Article 22. Information from managers of the first-unloading dairy centres.
Article 23. Sampling.
Article 24. Conditions to be met by the testing for bacterial growth inhibitor residues.

The Additional Provisions regulate the mutual recognition clause and the references to the national registry.
The Transitional Provisions include training, container labels, transfer of data in the “Letra Q” database, and sending samples.
The Derogating Provision provides for the repeal of legislation.
And the Final Provisions govern the jurisdictional authority, the power of amendment and the entry into force.

The draft is supplemented by seven technical annexes which include, respectively, the data to be incorporated into the “Letra Q database” by the competent body; the minimum content of the labels for the identification of tanks; the material used for the labels identifying containers; the minimum content and duration of the course for samplers; the minimum data to be reported to the “Letra Q database” by the laboratories; the minimum data to be communicated to laboratories by the first purchaser; and the minimum data to be reported to the “Letra Q
database” by dairy operators not classified as first buyers.
