Regulation of the Minister for Digitalisation on radio broadcasting or receiving radio equipment that can be used without a radio licence

The Regulation implements the statutory authorisation stemming from Article 144(3) of the Telecommunications Act of 16 July 2004 (Journal of Laws of 2021, item 576) authorising the Minister responsible for computerisation to extend the scope of radio broadcasting or receiving radio equipment which may be used without a radio licence, guided by the principle of increasing the number of types of such equipment, taking into account the need for a balanced frequency management, specifying the conditions for the use of radio broadcasting or receiving radio equipment which may be used without a radio licence, including in particular the requency ranges used by them, the maximum radiated power or maximum magnetic field strength and the area of use of such equipment, as well as the types of radio services. The proposed regulation takes into account, in particular, the provisions of the following implementing decisions of the European Commission and the recommendations of the CEPT (ECC/ERC), i.e.:
