Online content-sharing services (information society services)

Government proposal to Parliament for acts amending section 184 of the Copyright Act and the Act on Electronic Communication Services (draft)

Chapter 6a of the Government proposal (sections 55a to 55n) contains provisions implementing Article 17 of Directive (EU) 2019/790 (hereinafter ‘the DSM Directive’). The proposal includes the following obligations for information society service providers (online content-sharing service providers):

Section 55a; the responsibility of the online content-sharing service provider over copyright infringing material stored by the content provider
Section 55b; information obligation of the online content-sharing service provider
Section 55c; obligation of the online content-sharing service provider to prevent public access to material
Section 55e; notification to the content provider
Section 55f; obligation of the online content-sharing service provider to provide means of resolving disagreements in the service
