The draft concerns the cultivation, processing, treatment, marketing and possession of fibrous hemp and derived products.

Draft Act on Fibrous Hemps.

The draft aligns the Polish definition of fibre hemp with the new definition adopted in 2020 by the European Parliament: as plants of the species of Cannabis sativa L., in which the sum of the contents of delta-9-tetrahydrocannabinol and tetrahydrocannabinol acid (delta-9-THC-2-carboxylic acid) in floral or fruiting tops of plants, from which it will not be removed, does not exceed 0,3 % of dry mass. In the current legal state, the permissible maximum THC level has been set at 0,20 %. Thus, the proposal aligns the definition of fibrous hemp in the Polish law with the Regulation of the European Parliament and of the Council laying down rules on support on the basis of strategic plans drawn up by Member States under the common agricultural policy (CAP Strategic Plans) and financed by the European Agricultural Guarantee Fund (EAGF) and the European Agricultural Fund for Rural Development (EAFRD), repealing Regulation (EU) No 1305/2013 of the European Parliament and of the Council and Regulation (EU) No 1307/2013 of the European Parliament and of the Council, as amended by the European Parliament on 23 October 2020 (P9_TA(2020)0287, Common Agricultural Policy – Support based on strategic plans drawn up by Member States and financed by EAGF and EAFRD ***I).

The project also provides for simplification and acceleration of the possibilities for starting the cultivation by repealing the obligation for annual crop rotation and for an extension of the catalogue of uses of fibre hemp.
