Crumb rubber and rubber powder from the recycling of scrap tyres that will cease to be considered waste providing it complies with the provisions of the Ministerial Order.

Draft Ministerial Order establishing the criteria for determining when crumb rubber and rubber powder obtained from the recycling of scrap tyres and intended for certain applications ceases to be waste in the meaning of Law 22/2011 of 28 July on waste and contaminated soil.

This Ministerial Order, valid throughout the territory of the State, lays down the criteria for determining when crumb rubber and rubber powder obtained from the recycling of scrap tyres ceases to be considered waste in the meaning of Law 22/2011 of 28 July on waste and contaminated soil.

To this end, the order lays down requirements relating to:
1. scrap tyres, so that they may be subject to this recycling;
2. the control to be established by the producer over the waste being recovered;
3. the treatment to which the producer is required to subject the waste for the production of crumb rubber and rubber powder;
4. the specifications and standards to be complied with by the crumb rubber and rubber powder, and the control procedures to be carried out by the producer, in order to verify compliance with said requirements;
5. the obligations of the producer;
6. limitations on the use of crumb rubber and rubber powder;
7. monitoring by the Autonomous Regional Authorities;
8. the content of the declaration of conformity, on the fulfilment of the established criteria, which must accompany each consignment.
