NP organic fertilisers

Ministerial Decree updating Annex 2 ‘Soil improvers’ and Annex 7 ‘Tolerances’ of Legislative Decree No. 75 of 29 April 2010 on the reorganisation and revision of the guidelines on fertilisers, according to Article 13 of Law No. 88 of 7 July 2009

The draft consists of 3 articles and 2 annexes.

Article 1:
- updates Annex 2 ‘Soil improvers’ to Legislative Decree No. 75 of 29 April 2010 according to the Annex with the addition of a new type of soil improver composed of waste from the agri-food supply chain;
- updates Annex 7 ‘Tolerances’ to Legislative Decree No. 75 of 29 April 2010 according to the Annex with the addition of tolerances relating to the soil improver product composed of waste from the agri-food supply chain;
Article 2:
- states that the Decree will not restrict the placing on the market of fertilisers that have been legally produced and placed on the market in an EU Member State or Turkey, or that have been legally produced in one of the signatory States to the European Free Trade Association (EFTA) or a signatory to the agreement on the European Economic Area (EEA);
- states that the Ministry of Agricultural, Food and Forestry Policies is the competent authority for the use, where necessary, of the assessment procedures laid down in Regulation (EC) No 764/2008.
Article 3:
- grants a period of 12 months from the entry into force of the new measure in which to dispose of national fertilisers produced in compliance with the legislation in force prior to that date.
Annex 1 describes the changes made to Annex 2 ‘Soil improvers’:
- insertion of the product ‘Soil improver composed of waste from the agri-food supply chain’ into point 2.2 ‘Soil improvers’.
Annex 2 describes the changes made to Annex 7 ‘Tolerances’:
- insertion of the product ‘Soil improver composed of waste from the agri-food supply chain’ into point 4 ‘Soil improvers’ with the specific tolerances to be used for the product.
